Whether you are only considering filing for divorce or actually commencing the divorce process, there are certain actions you can take to protect yourself, your children and your property rights:

  • Get temporary orders from the court for child custody and visitation
  • Get temporary orders from the court regarding use of joint bank accounts and accumulation of debt
  • Get temporary orders from the court regarding the maintenance of the home and continuance of mortgage payments (and payment of other bills)
  • Collect proper documentation of all community and non-community property
  • Collect other essential information

Collecting proper documentation now can facilitate more efficient — and likely more fair — determinations during the division of property and debts. Obtaining temporary orders right away also serves to preserve the marital estate until the court has a chance to review your case and your divorce s resolved.
