In Texas, the court that handles your divorce also determines who gets physical and legal custody of the children. Most parents are awarded joint custody (called a joint managing conservatorship) in divorce, which means that they share the rights and duties related to taking care of their children. When considering child custody, the court makes decisions that it feels are in the best interest of your child. It is important to have an experienced lawyer on your side to help you convince the judge to make the right decision for your family.

Even though parents may be awarded joint custody, the court still usually designates the parent your child will live with most of the time. One parent becomes the primary joint managing conservator (the custodial parent), and one becomes the non-primary joint managing conservator (the noncustodial parent). This can be complicated, but I can help you understand the differences and the law.
